Antitrust laws are meant to protect trade and commerce from monopolies, unlawful restraints and unlawful business practices. The accuser may bring the defendant to court in the county the defendant resides or where goods or services are found.
The accuser may be allowed to recover three times the actual damages sustained by him or her if the defendant is found guilty in causing harm or damage to another person's business or property.
Antitrust offenses may be brought in state or federal court. If a business owner or business is found in violation of any of the antitrust laws, the California Attorney General may ask the courts to make the business forfeit their charter rights, franchises or privileges and powers and may ask for the dissolution of the corporation or association.
Not only business owners, but those who advise or aid are considered to be part of a conspiracy against trade and therefore may be held responsible as well.
