In California, embezzlement is defined as the fraudulent appropriation of property by someone to whom it has been entrusted.
If a person fraudulently takes, conceals or disposes of any goods or property that is not theirs to appropriate, they may be charged with embezzlement. Oftentimes, records are concealed to hide the missing items or monies.
Embezzlement differs from ordinary theft in two ways. First of all, the person must have legal access to the items, monies or goods in question. Second, a "conversion" must occur, meaning that a person may have taken goods or monies and may not still be in possession of them.
